1. Acceptance of Terms

By downloading, installing, or using Norakind ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Norakind ("we," "us," or "our").

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last Updated" date at the bottom of this page
• Posting a notice in the App (for significant changes)
• Sending a notification through the App Store (when applicable)

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 13 years old to use Norakind. If you are under 18, you should get permission from a parent or guardian to use the App.

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Description of Service

Norakind is a task management application designed for people with ADHD. The App provides features including:

• Task creation and management
• Daily Focus view
• Consequence framework for task prioritization
• If-then planning
• Repair plans for missed deadlines
• Labels and organization tools
• Optional iCloud sync (Premium feature)
• Recurring tasks (Premium feature)

The App is available for iOS 17+, iPadOS 17+, and macOS 14+ (Sonoma) and is distributed exclusively through the Apple App Store.

5. Free and Premium Features

Free Tier

The free version of Norakind includes:

• Up to 5 active tasks
• Up to 2 labels
• All core features (Daily Focus, Consequence Framework, If-Then Planning, Color tags)

Premium Subscription

Premium subscriptions are available as:

• Monthly subscription: $4.99/month
• Annual subscription: $39.99/year

Premium features include:

• Unlimited active tasks
• Unlimited labels
• iCloud sync across devices
• Repair Plans
• Recurring tasks
• Family Sharing (up to 5 members)

All premium subscriptions include a 7-day free trial. Future features may be available exclusively to Premium subscribers.

6. Payment and Subscriptions

All purchases and subscriptions are processed through the Apple App Store and are subject to Apple's Terms of Service.

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds are provided for unused portions of a subscription period

7. User Data and Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy.

Key points:

• We do not collect, store, or have access to your task data
• All data is stored locally on your device
• Optional iCloud sync uses your personal iCloud account
• We may collect crash reports and support inquiries if you submit them

8. Your Data and Content

You retain all rights to the content you create in Norakind (tasks, notes, plans, etc.). We do not claim ownership of your data.

You are responsible for:

• Maintaining backups of your important data
• The accuracy and legality of content you create
• Your use of iCloud sync (subject to Apple's iCloud Terms)

9. Acceptable Use

You agree to use Norakind only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent or disable any security features of the App
• Use the App to store illegal, harmful, or offensive content
• Interfere with or disrupt the App or servers/networks connected to the App
• Attempt to gain unauthorized access to any portion of the App
• Use the App for any commercial purpose without our written permission

10. Intellectual Property

The App and its original content, features, and functionality are owned by Norakind and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the App
• Distribute, sell, or transfer the App to third parties
• Use our trademarks, logos, or branding without permission

11. Third-Party Services

The App relies on certain third-party services:

• Apple App Store: For distribution and payments
• Apple iCloud/CloudKit: For optional data sync (Premium feature)

Your use of these services is subject to their respective terms of service and privacy policies.

12. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• Results from using the App will meet your requirements

Medical Disclaimer: Norakind is a productivity tool and is not intended to diagnose, treat, cure, or prevent ADHD or any other medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

13. Limitation of Liability

To the maximum extent permitted by law, Norakind and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, or goodwill
• Service interruption
• Computer damage or system failure
• Cost of substitute services

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Norakind and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data stored in the App

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users, us, or third parties
• Is otherwise inappropriate

You may stop using the App at any time by deleting it from your device.

Upon termination:

• Your right to use the App will immediately cease
• You should delete the App from all devices
• Provisions that by their nature should survive termination will survive

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiation first
• Binding arbitration if negotiation fails (subject to applicable law)

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

17. Apple App Store Requirements

This section applies to users who download the App from the Apple App Store.

Acknowledgments:

• These Terms are between you and Norakind, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for addressing any claims relating to the App
• In the event of any third-party claim that the App infringes intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of such claim
• Apple and its subsidiaries are third-party beneficiaries of these Terms

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Norakind regarding the App and supersede all prior agreements and understandings.
